An out of date Will leaves no provision for man’s children.....

The recent case of Ubbi vs Ubbi July 2018 demonstrates the importance of maintaining an up to date Will to reflect any important change in your personal circumstances.

Malkiat Ubbi was in the process of getting a divorce from his wife but died before this was finalised. He had children from a long term affair but had not yet updated his Will to include provision for these infants, which left them nothing from the £3.5m estate and everything to his wife. His mistress challenged the estate in the courts under the 1975 Inheritance Act, acting as a litigation friend on behalf of her children. Eventually they were awarded £386,000.

No one can know exactly what Mr Ubbi would have intended for his children. However, had Mr Ubbi updated his will, his precise wishes would have been carried out, likely removing the prospect of loved one’s being unaccounted for and the need for any stressful and expensive court proceedings.
