WILLS and TRUSTS
Why you should make a Will
Without a will, the distribution of your assets (estate) will be carried out according to the laws of intestacy which may not reflect your specific wishes.
Making a will enables you to plan exactly what will happen to your estate following your death to ensure that those you would like to benefit actually do so. The absence of a Will can cause financial hardship, unnecessary expense and heartbreak for your family.
Without a Will:
Your spouse/civil partner will not automatically inherit ALL of your estate
'Common Law' partners may not receive anything
Children under 18 could be taken into care whilst Guardians are appointed should the parents die.
There could be lengthy delays for your Beneficiaries
You will not be able to leave something to friends or charities if this falls outside the Rules of Intestacy.
With a valid up to date Will you can ...
Provide for those you choose in the way you wish
Protect your children - appoint your own Guardians
Be Tax efficient to ensure you don't pay inheritance tax unnecessarily
Save your family time and money and remove the burdens of additional stress when dealing with an estate where there is no Will
Give yourself peace of mind knowing that you have done everything you can to secure the future of your loved ones.
Trusts - protection for your family's inheritance that takes you one step further
Trusts can be used to protect family wealth through the generations, by preventing the loss of your assets from future events such as divorce, creditors and further Inheritance Tax bills. After your chosen beneficiaries receive their inheritance into their own estate, without the protective structure of a trust it can be lost or end up in the wrong hands!
